Law: LPKF Takes Legal Steps Against Patent Infringements

Unfortunately, with the success of LDS technology the number of cases in which the patented process is improperly used is also growing. Recently, electronics manufacturers have been increasingly offered inferior LDS components, so that LPKF has decided to pursue more vigorous legal proceedings against patent infringements. This also serves the interest of customers who have high expectations for LDS technology.

Asia is a particular hotspot for patent infringements of LDS technology. In the struggle against this misuse, initial successes are presenting themselves: thus a temporary order was issued against a manufacturer in Korea. A Korean court prohibited illegal use of the LDS process. In China there are still protracted legal disputes for LPKF after a Chinese investigation board declared an LPKF patent to be invalid. Petitions for nullity are standard procedures for avoiding threatening patent infringements. LPKF will contest this ruling with all available means.

Although LPKF sees good chances in the defense of its intellectual property, it should be emphasized that loss of a patent in China would not affect patent rights in most countries.

“We will also defend our patent rights in the interests of our customers with all means available to us,” announced LPKF Chief Executive Dr. Ingo Bretthauer. Along with legally protecting its interests, LPKF’s technological leadership is in itself an effective protection against unfair competition, according to Bretthauer.
